1. Agreement to these terms

These Terms and Conditions (“Terms”) govern your use of the Super Smiles website at supersmiles.au (the “Site”) and any services we provide (the “Services”). The Site and Services are operated by MEROITI, TUMAI (ABN 75 527 278 804), trading as “Super Smiles” (“we”, “us”, “our”). By using the Site or engaging our Services, you agree to these Terms. If you do not agree, please do not use the Site or Services.

2. Who we are and what we do

Super Smiles is a document-preparation and administrative support service. We help everyday Australians prepare and organise an application to the Australian Taxation Office (ATO) for the early release of superannuation on compassionate grounds, for dental treatment.

We are not the ATO, a superannuation fund, a financial adviser, a tax agent, a legal adviser, or a dental or medical provider. Your dentist and doctor make all clinical decisions, the ATO and your super fund decide your application, and you lodge it from your own myGov account. We cannot and do not guarantee any particular outcome. Please also read our Disclaimer.

3. Eligibility to use the Services

You must be at least 18 years old and an Australian resident with a superannuation account to use our Services. You are responsible for the accuracy and completeness of the information and documents you provide to us.

4. Your responsibilities

• Provide true, accurate and complete information.
• Obtain the required medical and dental reports from your own registered practitioners — the clinical content is always theirs.
• Keep your credentials private. We will never ask for your myGov login, and you should never share it with anyone.
• Use the Site and Services lawfully and only for their intended purpose.

5. Fees and payments

Your eligibility check and initial consultation are free and carry no obligation. We do not display service prices on this Site. If you choose to engage us, any fees for our Services will be explained to you clearly and in writing before you commit, and payment terms will be set out in that written agreement.

6. Third-party services and links

The Site may link to third-party websites and services (for example, an online booking tool, the ATO, or dental clinics). We do not control and are not responsible for third-party websites, content or practices. Your use of them is at your own risk and subject to their terms.

7. Intellectual property

All content on the Site — including text, graphics, logos and design — is owned by us or our licensors and is protected by law. You may not copy, reproduce or distribute it without our written permission.

8. Prohibited activities

You agree not to misuse the Site, including by attempting to gain unauthorised access, transmitting malicious code, scraping data, impersonating others, or using the Site in any way that is unlawful or harmful.

9. Your submissions

If you send us information through a contact form, our chat, or otherwise, you grant us permission to use it to respond to you and provide the Services, in accordance with our Privacy Policy.

10. Disclaimers

The Site and Services are provided “as is” and “as available”, without warranties of any kind to the extent permitted by law. Nothing on the Site is financial, tax, legal, dental or medical advice. See our Disclaimer.

11. Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) that cannot lawfully be excluded.

12. Limitation of liability

To the maximum extent permitted by law, and subject to your rights under the Australian Consumer Law, we are not liable for any indirect, incidental, special or consequential loss arising from your use of the Site or Services. Where our liability cannot be excluded but can be limited, it is limited to re-supplying the Services or paying the cost of having them re-supplied.

13. Indemnity

You agree to indemnify us against any loss or claim arising from your breach of these Terms or your misuse of the Site or Services, to the extent permitted by law.

14. Termination

We may suspend or end your access to the Site or Services at any time if you breach these Terms. You may stop using the Services at any time.

15. Governing law

These Terms are governed by the laws of Victoria, Australia, and you submit to the non-exclusive jurisdiction of the courts of Victoria.

16. Changes to these Terms

We may update these Terms from time to time. The current version is indicated by the “Last updated” date above and takes effect once posted. Please review this page periodically.
